These terms and conditions (“Terms”) govern your use of services branded under .co.uk domains held by sportivos limited including scottcormack, tivodoodle, tivotoons, tivofunnels, & tivocloud (collectively referred to as “we,” “our,” or “us”). 2. Scope of Service We act as a reseller of ClickFunnels software and related tools, which we have white-labeled under the brands tivodoodle, tivotoons, tivofunnels, & tivocloud. The services provided include access to software for creating online sales funnels, membership sites, and related resources.
3. Liability Disclaimer All services provided under our brands are powered by ClickFunnels software. We do not warrant or guarantee the performance, functionality, or availability of the software. You agree that we are not liable for any failures, downtime, or other issues arising from the ClickFunnels platform. For further details, refer to ClickFunnels' Terms of Service at www.clickfunnels.com.
4. Payment and Subscription Terms Payment for all services must be made in advance and will be billed on a recurring basis unless canceled as per the cancellation policy below. All payments will be processed in the currency specified during checkout. By subscribing to our services, you authorise automatic billing for recurring payments. Free trials, if offered, are governed by the terms specified at the time of registration. 5. Refund Policy Refunds for software and membership services are governed by ClickFunnels' refund policies. We do not issue refunds for services unless explicitly stated otherwise in ClickFunnels’ Terms.
6. User Responsibilities You are solely responsible for complying with all applicable laws and regulations in your use of the software and services. You agree to use the software only for lawful purposes and in accordance with these Terms. 7. Indemnification You agree to indemnify and hold harmless Sportivos Limited, its affiliates, and ClickFunnels from any claims, damages, or expenses arising from your use of the software or any violation of these Terms.
8. Limitation of Liability Sportivos Limited and its affiliated brands disclaim all liability for any damages resulting from software outages, performance issues, or user error. 10. Amendments to Terms We reserve the right to update these Terms at any time to reflect changes in business operations or statutory requirements. Updates will be posted on www.scottcormack.co.uk and will take effect immediately.
11. Governing Law This agreement is governed by and construed in accordance with English law. Disputes shall be subject to the exclusive jurisdiction of the courts of England.
